2 CPD Hours

The Disclosure Pilot, which will run for two years, commenced on 1st January 2019 in the Business and Property Courts. The impact of this Pilot on how e-disclosure is handled will be significant.

This interactive seminar will enable attendees to examine the broad menu of disclosure options found within CPR 31.5 (7) which were introduced following the 2013 Jackson reforms, before considering standard disclosure which remains the default for most cases. Attendees will then consider the impact of the digital age and the need for change. Attendees will go on to explore the applicability of Practice Direction 51U and the 4 stages of disclosure under the scheme.

The 5 disclosure models will be considered and delegates will be given an opportunity to familiarise themselves with the applicable documentation including the disclosure review document and the disclosure certificate.

Finally, the session will involve a discussion on what this will mean for budgeting and your day to day role including the steps that may need to be taken where the disclosure phase of a budget cannot be completed prior to a CMC.

 Topics to be covered include:

  • Standard Disclosure
  • Duties
