Form Update (The new Statement of Costs pilot (the N260A and N260B) and the updated budget discussion report (Precedent R))

This seminar is designed to provide an overview of the pilot scheme for the new Statement of Costs for Summary Assessment (1 April 2019 to 31 March 2021) and the amendments to Practice Direction 3E which will come into force on the 25 April 2019.

The seminar will cover the content and scope of Practice Direction 51X to ensure practitioners have a detailed grasp of the form and content of the model forms of Statement of Costs which may be used for Summary Assessment on an interim application (the N260A) and at Trial (the N260B).

Delegates will consider the relationship of the new Statement of Costs to the New Format Bill including the requirement for a document schedule. Delegates will explore filtering time records by creating a document schedule using the same activity code found in CPR Practice Direction 47, Schedule 2.

Delegates will also consider how to streamline the billing process so as to avoid the duplication of work and consider alternative ways of creating compliant Statements of Costs that will meet the needs of parties, practitioners and the Courts.  

Delegates will then consider the amendment to Practice Direction 3E and the updated Precedent R. This will include some discussion of recent authority and the risk that judges may be encouraged to focus on the constitute elements of the budget rather than the total figures for the budgeted costs of each phase.
