N.B. the search the facility cannot filter out all unrelated SI.s and care should be taken to check the name of the SI relates to the one you are looking for. The Legal Services Commission Manual featured amended versions of the SI.s and these were eventually included as PDFs on the Commission’s website and the links to these pages and some directly to the remuneration and general regulations under the Legal Aid Act 1988 that were amended for CLS Funding Certificates for have been provided.

The Community Legal Service (Funding) Order 2007 - replaced the 1991 and 1994 remuneration regulations, the remaining provisions of the 1989 general regulations and the 2000 Order in line with the new funding scheme under the Unified Contract from 1st October 2007. 

The Community Legal Service (Funding) (Counsel in Family Proceedings) Order 2001 – provided for the Family Graduated Fee Scheme (‘FGF’) for counsel’s fees in family proceedings which was replaced by the Family Advocacy Scheme (‘FAS’) under The Community Legal Service (Funding) (Amendment) Order 2011 from 9th May 2011.

The Community Legal Service (Funding) Order 2000 (full search of original and all amending regulations) – delegated remuneration rates for controlled work to the Legal Advice and Assistance Regulations 1989 until 2nd April 2001. Delegated many of the assessment procedure provisions to the Civil Lega Aid (General) Regulations 1989, and all the remuneration rates and enhancement criteria to the previous 1991 and 1994 regulations, until the Order was revoked (subject to savings/transitional provisions) and replaced by the 2007 Order on 1st October 2007.

The Community Legal Service (Funding) Order 2000 (as amended) – with all amendments up to and including 2001 applying to CLS Funding Certificates (N.B. there were six further amendments from 2002 to 2006 which are not included in this document). 

The Legal Aid in Civil Proceedings (Remuneration) Regulations 1994 (full search of original and all amending regulations) - applies to CLS Funding Certificates applied for before 1st October 2007

The Legal Aid in Family Proceedings (Remuneration) Regulations 1991 (full search of original and all amending regulations) - applies to CLS Funding Certificates applied for before 1st October 2007

The Legal Aid in Family Proceedings (Remuneration) Regulations 1991 (as amended) – with all amendments applying to CLS Funding Certificates applied for before 1st October 2007, excluding amendments harmonising private family law rates from 2 April 2007.

Civil Legal Aid (General) Regulations 1989 (full search of original and all amending regulations) – the provisions remaining under the 1999 Act (in below ‘as amended’ document) were mainly for assessment procedure and applies to CLS Funding Certificates applied for before 1st October 2007 (when many were replaced by the provisions in the new Specification to the Unified Contract).

The Legal Advice and Assistance Regulations 1989 – provided remuneration rates for Legal Advice and Assistance (‘Green Form’) and Advice By Way of Representation (ABWOR). It also initially provided the remuneration rates (as delegated by the Community Legal Service (Funding) Order 2000) for the controlled work scheme (e.g. Legal Help & Controlled Legal Representation). These regulations also provided remuneration provisions for criminal work.
